Terms and Conditions of Sale

Article 1 - Purpose
These general terms and conditions of sale (hereinafter the "Terms") govern the contractual relationship between Infini'click, a French limited liability company (S.A.R.L.) with capital of €1,540, registered with the La Roche-sur-Yon Trade and Companies Register under number 480 303 809, whose registered office is located at 16 rue Dumaine - 85400 Luçon, France (hereinafter the "Provider"), and any individual or legal entity acting in a professional capacity who subscribes to the InfiniThumbs service (hereinafter the "Customer").
Any subscription to the service implies the Customer's full and unreserved acceptance of these Terms.
Article 2 - Description of the service
InfiniThumbs is an automated web page thumbnail (screenshot) generation service, accessible via an HTTP API secured by an authentication key.
The service includes:
- The assignment of a personal API key
- Use of this key on the number of sites provided for by the subscribed plan (1, 5 or 15 sites)
- A call quota based on the subscribed plan
- Access to a customer area to review usage and manage the subscription
Article 3 - Access conditions
The service is reserved for professionals (B2B) within the meaning of the French Consumer Code. The Customer represents that they are subscribing as part of their professional activity.
Subscribing requires the prior creation of an account on https://thumbs.infiniclick.fr and providing accurate, up-to-date information.
Article 4 - Pricing and subscription
Current pricing for the various plans is published on the homepage of thumbs.infiniclick.fr. Prices are shown in euros, all taxes included (VAT incl.).
The subscription is taken out for a fixed term and is not automatically renewed. Upon expiry of the subscribed period, the subscription terminates automatically. Renewal is at the Customer's sole initiative, who may take out a new subscription at any time.
Upon renewal, the API key assigned to the Customer remains unchanged; only the expiry date is updated.
Article 5 - Payment terms
Payment is made online via PayPal, by credit card or PayPal account. The transaction is secured directly by the payment provider; no banking data is stored by the Provider.
Payment is due upon subscription. An invoice is issued and made available to the Customer in their customer area as soon as payment is confirmed.
Article 6 - Service availability upon subscription
The API key is generated and activated immediately after payment is confirmed. It can be viewed in the customer area and used as soon as it is created.
Article 7 - No right of withdrawal
In accordance with Article L221-3 of the French Consumer Code, as the service is subscribed to as part of a professional activity (B2B), the Customer does not benefit from any right of withdrawal.
Furthermore, as the service is provided in digital form and usable as soon as payment is confirmed, all subscriptions are final and non-cancellable.
Article 8 - Service availability
The Provider undertakes to use reasonable means to ensure service availability. A target availability rate of 99% monthly average is aimed for, excluding scheduled maintenance and force majeure events.
Interruptions required for maintenance, updates or securing the service do not give rise to any compensation. The Provider strives to carry these out outside peak usage periods and to inform Customers whenever possible.
Article 9 - Customer obligations
The Customer undertakes to:
- Keep their API key confidential and not disclose it to third parties
- Only use the key on the number of sites provided for by their plan
- Not attempt to bypass the service's quotas, rate limits or security mechanisms
- Not use the service to capture unlawful, offensive, or copyright-protected content without authorization
- Report any suspected compromise of their key without delay
Article 10 - Suspension and termination
The Provider reserves the right to immediately suspend or revoke, without notice or refund, any API key in the event of:
- Breach by the Customer of any of their contractual obligations
- Abusive or fraudulent use of the service
- Activity liable to harm the security or stability of the service or its users
Article 11 - Liability
The Provider cannot be held liable for indirect damages suffered by the Customer, including loss of business, loss of revenue, data loss or reputational harm.
In any event, the Provider's liability, on any grounds whatsoever, is expressly limited to the amount of the subscription paid by the Customer over the past twelve (12) months.
Article 12 - Personal data
Data collected during subscription is necessary for order processing, subscription management and invoicing. It is retained for the legally required period and is never disclosed to third parties without written consent.
In accordance with the GDPR and the French Data Protection Act, the Customer has the right to access, rectify and delete data concerning them. Any request must be sent to infos@infiniclick.fr.
Article 13 - Amendments to these Terms
The Provider reserves the right to amend these Terms at any time. Changes apply to new subscriptions and to the renewal of existing subscriptions.
Article 14 - Governing law and jurisdiction
These Terms are governed by French law. In the event of a dispute, and failing an amicable resolution, exclusive jurisdiction is granted to the Commercial Court of La Roche-sur-Yon.
